1-Gun law

Analysis: The second amendment gives the right to all the citizens to own a gun. Denying any

citizen the right to own a gun is unconstitutional. The district attorney of a New York County has

prohibited the prosecutors from owning a gun and this appears to be a violation of the second

amendment. The compelling government interest to prohibit the prosecutors from carrying a gun

is to control the gun incidents, which have become common these days. The New York

prosecutors have got into trouble because of owning handguns and therefore banning gun

ownership can help the government to control the gun issues and gun incidents related with New

York prosecutors to some extent (Turley, 2015).

2-Environmental regulation

Analysis: The 1973 Endangered Species Act provides for the conservation of ecosystems on

which the endangered and threatened plants, wildlife and fish depend. The Act provides the

authority to acquire land to conserve the listed species using land and water conservation funds.

The Section 7 of the Act ensures that none of the actions authorized, funded or carried out by the

Federal agencies will jeopardize the “continued existence of listed species or modify their critical

habitat” (Endangered Species Act of 1973, n.d.).

Analysis: The denial of religious exemption is not in the compelling interest of the government.

a person’s exercise of religion even if the burden results from a rule of general applicability,

except as provided in subsection (b) of this section, which states –Exception-Government may

substantially burden a person’s exercise of religion only if it demonstrates that application of the

burden to the person – 1) is in furtherance of a compelling governmental interest; and 2) is the

least restrictive means of furthering that compelling governmental interest” (42 U.S. Code §
