Facts: The city of Carmel has proposed a new anti-discrimination ordinance that seeks to

protect residents of Indiana from discrimination based on a person’s race, color, religion,

national origin, gender, disability, sexual orientation, gender identity or expression, family or

marital status, ancestry, age, and/or veteran status. The ordinance is proposed to be applicable to

individuals doing business, obtaining housing, using public accommodations, obtaining

education or employment, entering into contracts or participating in programs, services, or

amenities provided to the general public (Erdody, 2015). Anyone who violates the ordinance

could be assessed a $500 fine plus attorney's fees for each offense, each person and each day the

violation continues. Mayor Jim Brainard drafted the ordinance in consultation with the City’s

legal department and the co-sponsorship by six out of the seven council members.

Issue: Whether ORDINANCE D-2224-15 is an infringement of First Amendment

Freedoms of religion, conscience and expression?

Rule: The 1st Amendment’s Religion and Expression Clause states, “Congress shall

make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or

abridging the freedom of speech, or of the press; or the right of the people peaceably to

assemble, and to petition the Government for a redress of grievances.”


California Vaccination Bill Analysis

FACTS: The California Assembly passed the California Vaccination Bill in

June 2015 imposing one of the strictest school vaccination laws in the country. The law

requires most schoolchildren to be vaccinated against diseases included measles and

whooping. The move to pass the law came after about 100 people were infected with a

measles outbreak in 2014 at Disneyland. The new measures would exempt only those

children who have serious health issues. Children who are unvaccinated must be home-

schooled, as a measure of strict implementation of the bill. The Supreme Court has upheld the

issue of informed consent and parental rights, despite parents opposed to the bill threatening

ISSUE: Does the California Vaccination Bill infringe on parental rights as

guaranteed by the Fourteenth Amendment?

RULE: The Fourteenth Amendment provides that “no state shall

deprive any person of life, liberty or property, without due process of law; nor deny to any

person within its jurisdiction the equal protection of the laws.”
